Special needs trusts are legal documents created to maximize the available public and private resources available to disabled persons as well as to avoid using all the family funds to support the disabled person to the exclusion of other family member’s needs. Special needs trusts must be clear and say that trust assets will be used to supplement the other income sources and that the trust monies will not be used for necessities – such as food, clothing, shelter and basic medical needs.
